We are firmly committed to maintaining the security and confidentiality of personal information collected on this site. The purpose of this policy is to outline how the UK Hydrographic Office has established measures to protect your privacy and information rights. Why are we collecting or processing your data?  

 

Under the Data Protection legislation, we have a number of lawful reasons we can use (‘or process’) your personal data. When using admiralty.co.uk website users may be required to provide personal data, such as contact details (first name, last name, e-mail address, organisation).  Where personal information is provided, this may be used to provide information on new products and services, except where a website user has indicated otherwise. In any case, personal information will not be passed to a third party. On written request, users may, view the information we hold about them and request that we update, correct or delete it. 

The Information Charter sets out the standards you can expect from the UKHO when we request or hold information, including but not limited to personal data about your enquiries.

 

When you consent to providing us with personal data, we promise: 

 

  • To only ask for what we need, and not to collect too much or irrelevant information 

  • To make sure you know why we need it 

  • To check the information we hold is accurate and up-to-date 

  • To protect the information and make sure nobody has access to it who shouldn't 

  • To make sure we don't keep it longer than necessary 

  • Not to make your personal information available for commercial use without your permission 

In return, we ask you to provide us with accurate information and inform us about any relevant updates, such as a new address. 

 

Our legal basis for processing your personal data:

 

Under the Data Protection legislation, one of the lawful bases to processing data is ‘legitimate interests’, which basically means we have a genuine and legitimate reason to processing data (e.g. to provide the product or service) and we are not overriding your fundamental rights or freedoms as an individual. 

The following are some examples of when and why we use legitimate interests in our work: 

  • Best interest. Processing your information to protect you against fraud and to ensure our websites and systems are secure. 

  • Personalisation: Where the processing enables us to modify, personalise or otherwise improve our services/communications for your benefit 

  • Analytics: To process your personal information for the purposes of customer analysis, assessment, profiling and direct marketing, on a personalised or aggregated basis, to help us with our activities and to provide you with the most relevant information as long as this does not harm any of your rights and interests.  

  • Research: To determine the effectiveness of promotional campaigns and advertising and to develop our products, services and relationships with you. 

When someone visits our website, we use cookies to collect standard information about your general Internet usage. A cookie is a small piece of data that your Internet browser stores on your hard drive and is used when you visit the site to tailor your viewing and provide you with customised information. Only the information that you provide, or your preferences while visiting a website, can be stored in a cookie. For example, Our Site cannot determine personal details, such as your email address, unless you choose to submit them.  

We use Google Analytics to collect, analyse and review this personal data, from which, we are able to analyse online behaviour, and provide the best experience through improving our website. 

We collect this information in a way which does not identify anyone. We do not make any attempt to find out the identities of those visiting our websites. We will not associate any data gathered from this site with any personally identifying information from any source. We will make it clear when we collect personal information and will explain what we intend to do with it. 

We use this information to make each visit more rewarding and to provide us with information to help improve our service. We do not know (and do not wish to know) the identities of the individuals who visit our website

Personal data will be no shared with any third parties.

 

For how long we will keep the personal data, or criteria used to determine the retention period:

 

We will only retain your personal information for as long as necessary to fulfil the purposes we collected it for, including the purposes of satisfying any legal and regulatory requirements. 

Unless otherwise specified, we will hold your personal information: 

  • In accordance with our business needs, i.e. managing our relationship with you

  • Whilst we provide you with our services

  • In accordance with our contractual retention period

  • In accordance with any legal and regulatory requirements.

To determine the appropriate retention period for personal information, we consider the amount, nature and sensitivity of the personal information, the potential risk of harm from unauthorised use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements. After the retention period, has elapsed all data will be destroyed securely in line with MOD data destruction policy.

 

Your rights:


 

Under GDPR you have the following rights with regards to your personal data: 

  • The right to be informed about the collection and use of your personal data 

  • The right of access your personal data and supplementary information 

  • The right to have inaccurate personal data rectified, or completed if it is incomplete 

  • The right to restrict processing in certain circumstances 

  • The right to object to processing in certain circumstances 

  • The right to withdraw consent (where relevant) 

  • Right to complain to the information Commissioner 

 

At any one time, you have the right to be forgotten without undue delay Through these commitments, we will keep to UK Law, including the Data Protection Act 1998, General Data Protection Regulation 2018 and the Freedom of Information Act 2000. 

 

Transfer of personal data to other countries: 

 

This data will not be sent overseas. 

 

Automated decision making:

 

This data will not be used for any automated decision making. 

 

How we store personal data: 

 

This data will be stored in a secure government IT system. UKHO protect its commercial sites and products from cybercrime by design, ensuring it and its customers can feel safe in the knowledge that UKHO hosts a stable and innovative cyberspace presence which the public can use safely. This statement is validated by independent testing in line with UK government policy. UKHO systems are also accredited in line with UK government Security Policy Framework (SPF) and in line with ISO27001.

Certain areas of the Site are only open to you if you have been provided with a relevant password. The UKHO reserves the right to suspend or terminate your access and use of the Site at any time.

The UKHO reserves the right, at its discretion, to make changes to any part of the Site, including these terms. You are responsible for regularly reviewing information posted online to obtain timely notice of such changes. Your continued use of this site after changes are posted constitutes your acceptance of the revised terms.

The trademarks and logos (the 'trademarks') used and displayed on this Site are registered and unregistered trademarks of the UKHO and others. Governing law


These terms shall be governed by, and construed in accordance with English Law, and subject to the exclusive jurisdiction of the English Courts. All work the UKHO creates is protected by Crown copyright and/or database rights in the UK, and it is also protected elsewhere in the world through international treaties.

 

General


You may not assign, sub-license or otherwise transfer any of your rights under these Terms. If any provision of these terms is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. Failure by either party to exercise any right or remedy under these Terms does not constitute a waiver of that right or remedy.

As a data controller under the Data Protection Act, 1998 the Secretary of State for Defence of the United Kingdom of Great Britain and Northern Ireland, acting by the United Kingdom Hydrographic Office (UKHO) is committed to protecting and respecting your privacy.  

 

This policy, together with our end-user licence agreement for the App: the "licence" and any additional terms of use incorporated by reference into the licence, applies to your use of:

  • ADMIRALTY H-Note version 1.0 and any updates or new versions of ADMIRALTY H-Note made available to you (the "App") available on our site or hosted on third party app stores, on your mobile telephone or handheld device ("Device")

  • Any services accessible through the App ("Services"), unless the licence states that a separate privacy policy applies to a particular Service, in which case that privacy policy only applies

 

This policy outlines how UKHO data collected from you, as a result of your download and use of the App, will be processed and used by us.
 

Informed gathered from your use of our mobile App


UKHO may collect and process the following information about you:

  • Submitted information: Information that you provide by filling in forms within the App and as part of the services and on the App

  • Site, including the device's telephone number. This includes information provided at the time of registering to use the App (if necessary) or any services, subscribing to any services, posting material or requesting further services. UKHO may also ask you for information when you report a problem to us

  • Device information: UKHO may collect information about the device or any computer you may use to download a copy of the App onto your device, including, where available, the device's or computer's unique device identifiers (including IP address if applicable), operating system, browser type and mobile network information as well as the device's telephone number, for system administration and to report aggregate information to our advertisers. UKHO may associate device information with submitted information and will treat the combined information as personal data in accordance with this policy for as long as it is combined.

  • Location information: When you use one of our location-enabled services, UKHO may collect and process information about your actual location. Some of these services require your personal data for the feature to work. If you wish to use the particular feature, you will be asked to consent to your information being used for this purpose. You can withdraw your consent at any time by contacting us on customerservices@ukho.gov.uk.

  • Log information: When you use the App and any Services, UKHO may automatically collect and store certain information in server logs, including but not limited to internet protocol (IP) addresses, internet service provider (ISP), clickstream data, browser type and language, viewed and exit pages and date or time stamps.

  • Unique application numbers: When you install or uninstall a service containing a unique application number or when such a service searches for automatic updates, that number and information about your installation, for example, the type of operating system, may be sent to us.

 

Other information:


 (i)  if you contact us, UKHO may keep a record of that correspondence

(ii)  details of transactions you carry out through the App and of the fulfilment of your orders

 

Where UKHO store your personal data


UKHO may transfer any data that that UKHO collect from you to a location outside of the European Economic Area (EEA) and store it there. Your data may also be processed by staff working outside of the EEA who work for us or for one of our suppliers. These staff may be engaged in the fulfilment of your request, order or reservation, the processing of your payment details and the provision of support services. By sending us your personal data, you are agreeing to this transfer, storing or processing. UKHO will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy.

All information you provide to us is stored on our secure servers. Any payment transactions carried out by us or our chosen third-party provider of payment processing services will be encrypted using industry standard secure technology. Where UKHO have given you (or where you have chosen) a password that enables you to access the app and your account, you are responsible for keeping this password confidential. You should not share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although UKHO will do our best to protect your personal data, UKHO cannot guarantee the security of your data transmitted through or from the App. Any such transmission is at your own risk. Once UKHO have received your data, UKHO will use strict procedures and security features to try to prevent unauthorised access.

UKHO may collect and store personal data on your device using application data caches for the purpose of using the App only.

 

How we will use your information


UKHO use data held about you in the following ways to help maintain and improve our App functionality;

  • Submitted information: To record hydrographic observations

  • Device information: To use the device capability

  • Location information: To assist hydrographic observations

  • Log information: To support the App

  • UKHO will not disclose information about identifiable individuals to any advertisers, through the use of the App

 

Disclosure of your information

 

UKHO may disclose your personal data to third parties: 

  • if UKHO sell or buy any business or assets, in which case UKHO may disclose your personal data to the prospective seller or buyer of such business or assets

  • if UKHO or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets

  • if UKHO are under a duty to disclose or share your personal data in order to comply with any legal or regulatory obligation or request and in order to:

  •  (i) enforce or apply the licence and other agreements or to investigate potential breaches; or
    (ii) protect the rights, property or safety of UKHO our customers, or others, including exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction

 

Your Rights

 

You have the right to ask us not to process your personal data for marketing purposes. UKHO will usually inform you (before collecting your data) if UKHO intend to use your data for such purposes or if UKHO intend to disclose your information to any third party for such purposes. You can exercise your right to prevent such processing by ticking certain boxes on the forms UKHO use to collect your data. You can also exercise the right at any time by contacting us via email on customerservices@ukho.gov.uk.

 

Our App site may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates (including, but not limited to, websites on which the app or services are advertised). If you follow a link to any of these websites, please note that these websites and any services that may be accessible through them have their own privacy policies and that UKHO do not accept any responsibility or liability for these policies or for any personal data that may be collected through these websites or services, such as contact and location data. Please check these policies before you submit any personal data to these websites or use these services.

 

Access to stored information

 

The Data Protection Act 1998 gives you the right to access information held about you. Your right of access can be exercised in accordance with that Act. Any access request may be subject to a fee of £10 to meet our costs in providing you with details of the information UKHO hold about you.

 

Changes to this policy

 

Any changes UKHO may make to our privacy policy in the future will be posted on the UKHO website and, where appropriate, you may be notified by email or when you next start the App. The new terms may be displayed on-screen and you may be required to read and accept them to continue your use of the App or any services.
